These Terms of Service ("Terms") govern your use of the websitewebtechsolution.site and any services provided by WebTech Solutions Pvt. Ltd. ("WebTech", "we", "us"), registered in Nepal and operating from Main Road, Damak-04, Jhapa, Koshi Province, Nepal. By using our website or engaging our services, you agree to these Terms. If you don't agree, please don't use our services — though we'd genuinely like to hear why, so we can fix it.
1. Our Services
We provide web development, mobile application development, digital marketing, UI/UX design, cloud hosting and IT consulting services. Every engagement is governed by a separate written proposal or contract ("Project Agreement") that specifies scope, deliverables, timelines and pricing. Where a Project Agreement and these Terms conflict, the Project Agreement wins for that project.
2. Quotations & Payment
- Quotations are free, itemized and valid for 30 days unless stated otherwise
- Prices are quoted in Nepali Rupees (NPR) unless agreed otherwise in writing
- Standard payment structure: 40% advance, 30% at design approval, 30% before launch, unless a Project Agreement specifies differently
- Late payments (14+ days overdue) may pause work and accrue interest at 10% per annum on the overdue amount
- Delivered work remains our property until paid in full — it's only fair
- All payments are strictly non-refundable — please refer to Section 3 (Refund Policy) below
3. Refund Policy — No Refunds
All payments made to WebTech Solution Pvt. Ltd. are final and strictly non-refundable. Under no circumstances shall WebTech Solution be obliged to refund, in whole or in part, any advance, milestone, subscription, hosting, domain, maintenance or other fee paid in connection with its services.
By engaging our services and making any payment, you acknowledge and agree that: (a) work commences and resources are allocated upon receipt of payment; (b) each payment compensates WebTech Solution for the time, expertise and resources committed and the work performed up to that point; (c) a change of mind, a change in your business circumstances, or a failure to provide timely inputs, content or approvals shall not constitute grounds for a refund; and (d) third-party costs incurred on your behalf — including, without limitation, domain registrations, hosting, licences and paid tools — are likewise non-refundable.
If an engagement is terminated for any reason, all amounts already paid shall be retained by WebTech Solution against work completed and resources committed up to the date of termination, and all outstanding amounts for work performed shall remain payable in accordance with Section 12 (Termination). Nothing in this Section shall be construed so as to exclude any right or remedy that cannot lawfully be excluded under the laws of Nepal.
4. Client Responsibilities
Great projects are collaborations. You agree to: provide accurate information and content (or buy our content services), review and approve deliverables within agreed timelines, ensure you own or have rights to all materials you provide (text, images, logos), and maintain credentials for accounts under your control. Delays in your feedback extend project timelines by the same duration.
5. Timelines & Delivery
We commit to the schedule in your Project Agreement and communicate proactively if anything threatens it. What we don't do is promise miracles: timelines assume the client feedback cycle above, changes requested outside the agreed scope are quoted separately, and events beyond our control (think strikes, bandwidth apocalypse, acts of the gods) may require reasonable schedule adjustments.
6. Revisions & Scope Changes
Each project includes the revision rounds specified in its Project Agreement — and we're famously reasonable about small tweaks. Work beyond the agreed scope ("I know we said 5 pages, but what about 15?") is quoted before it's done, never billed as a surprise afterwards.
7. Ownership & Intellectual Property
Upon full payment, you own the final deliverables created for your project — source code, designs and content. We retain the right to display your project in our portfolio unless you request otherwise in writing (we respect NDA restrictions). Pre-existing tools, frameworks and libraries we use remain governed by their own licenses; typically, they're open-source and freely usable.
8. Website Content & Acceptable Use
Our website content is for information. You agree not to misuse our website or services — no unlawful, fraudulent, infringing or malicious activities, no scraping, no interfering with our infrastructure, no trying to hack us to "test" our security without written permission (ask about our bug bounty appreciation program instead).
9. Warranties & Disclaimers
We warrant that services will be performed with professional skill and care — this is our reputation, and we guard it fiercely. Beyond that, our services are provided "as is". We can't guarantee specific revenue, search rankings or business outcomes, since these depend on factors beyond anyone's control. Third- party services (payment gateways, hosting partners, platform APIs) carry their own warranties, not ours.
10. Limitation of Liability
To the maximum extent permitted by Nepali law, our total liability for any claim relating to our services is limited to the amount you paid us for the service giving rise to the claim. We're not liable for indirect or consequential losses (lost profits, lost data, business interruption). This doesn't apply to liability that can't be limited by law, or to willful misconduct — which we don't plan on committing.
11. Support & Maintenance
Every project includes the free support period stated in its Project Agreement. Beyond that, ongoing care requires an active maintenance plan — because our engineers deserve salaries, and your systems deserve attention. Emergency support is available for active hosting and maintenance clients.
12. Termination
Either party may end a service engagement with written notice per the Project Agreement. You pay for work completed to date; we hand over everything paid for — source code, credentials, documentation — in an orderly, professional manner. Sections on confidentiality, liability and ownership survive termination.
13. Governing Law
These Terms are governed by the laws of Nepal. Disputes will first be addressed through good-faith negotiation (a conversation, over tea, usually works), and failing that, through the courts of Jhapa district, Nepal.
14. Changes to These Terms
We may update these Terms; the current version always lives at this URL with its effective date. Material changes affecting active clients will be communicated directly. Using our services after changes means acceptance.
